Dawson & Sodd partner Clint Schumacher recently added a new episode of his Eminent Domain Podcast! In Podcast Episode 19, Schumacher discusses with New Jersey attorney Anthony DellaPelle an interesting public use issue that DellaPelle is facing.
In this episode, Schumacher also reviews the case history of St. Bernard Parish v. United States, which arose out of the post-Hurricane Katrina flooding in Louisiana. In this case, the Louisiana parish government and private property owners filed an inverse condemnation lawsuit against the U.S. Army Corps of Engineers.
Although the Court of Federal Claims found in favor of the landowners in the initial lawsuit, the Federal Circuit reversed the decision on appeal. In September 2018, the property owners filed a writ of certiorari.
